The owner understands and agrees that Cook Farms will exercise reasonable care and precaution in the handling and care of all pets; however, no guarantees are made regarding the pet’s health, behavior, or safety.
The owner acknowledges that boarding and interaction with other animals involve inherent risks, including but not limited to illness, injury, parasites, stress, escape, or death, even when reasonable care is exercised.
Loss or Damage Beyond Control: Cook farms shall not be held liable or responsible for any loss, injury, illness, or death of the pet resulting from causes beyond its reasonable control. This includes, but is not limited to:
Acts of God: Natural disasters, floods, or extreme weather conditions.
Fire: Damage or loss resulting from accidental fire or smoke.
Theft: Criminal acts or theft, provided that Cook Farms has maintained reasonable security measures.
Cook Farms does house intact dogs. While proper care will be given Cook farms will not be held responsible for accidental pregnancy.
In accordance with the laws of the State of North Carolina, the owner knowingly and voluntarily assumes all risks associated with boarding their pet.
The owner hereby releases, waives, and discharges Cook Farms, its owners, agents, and employees, including Darlene and Rick Cook, from any and all liability, claims, demands, actions, or causes of action for injury, illness, loss, damage, or death of the pet, except in cases of gross negligence or willful misconduct.
The owner further agrees to indemnify, defend, and hold harmless Cook Farms and its owners from any and all claims, liabilities, damages, costs, and expenses (including reasonable attorney’s fees) arising out of or related to:
The pet’s behavior or actions (including bites or injuries to other animals or people)
Any damage caused by the pet
Any claims brought by third parties related to the pet’s stay
This provision is intended to be as broad and inclusive as permitted under North Carolina law.
